Mumbai: where will the new council of ministers be sworn in? It’s not clear. “It will depend on the new chief minister. He will have to choose the venue. But since it will be the first event of the newly elected government, the chief minister will prefer it to be held outside Raj Bhavan,” a senior official told TOI .
In 2014, the Devendra Fadnavis government’s swearing-in ceremony was held at Wankhede Stadium, while undivided Shiv Sena leader Uddhav Thackeray was at Shivaji Park in 2019.
On government formation, the official said that if MVA or Mahayuti obtained a clear majority, it would be a simple matter: Since both are pre-election alliances, either would be considered a single party. “Then the governor will invite Mahayuti or MVA candidates to form the government.” According to the procedure, if the invitation is not issued by the governor, the alliance which obtains a simple majority can claim the formation of the government.
Even if Mahayuti or MVA obtains a clear majority, the governor has the option of inviting the leader of the largest party to form the government.
If neither alliance obtains a clear majority, the governor will play a major role in forming the government. According to the convention, he will call the leader of the largest party to form the government, and if this leader accepts the invitation, he will have to prove his majority in the House within a time prescribed by the governor.
If there is no response from the leader to the invitation, the governor will call the leader of the next party in line. If each of the subsequently called parties fails to form a government, the only option available to the governor would be to impose presidential rule for a limited period.
The term of the current Assembly ends on November 26. The government formation process must be completed before this date.
